Patra Challenges Gandhi's Interpretation of Supreme Court Proceedings

New Delhi, Oct 5 (SocialNews.XYZ) — BJP national spokesperson Sambit Patra on Monday rebutted Leader of Opposition Rahul Gandhi’s allegations concerning Form 6, the Election Commission, and the Special Intensive Revision (SIR) of electoral rolls. Addressing a press conference in New Delhi, Patra accused Gandhi of spreading misleading information about Supreme Court proceedings and misrepresenting the court's observations. Patra stated that Gandhi wrongly suggested the Supreme Court established Chief Election Commissioner Gyanesh Kumar had illegally and unilaterally altered Form 6 to benefit the BJP. The allegations were made by Gandhi in a post on X shortly after the Supreme Court hearing, according to Patra. According to Patra, Gandhi claimed in his X post that it was established "without any doubt" that Kumar had illegally changed Form 6 and misused his position. Gandhi further alleged that those responsible for what he described as an attack on democracy would have to be held accountable. Patra rejected Gandhi’s interpretation, asserting the Supreme Court did not declare Form 6 illegal or reject it. He cited Chief Justice Surya Kant’s observation that the court had not approved any changed Form 6 and required examination of the official record to determine who made the changes. Patra argued this observation could not be interpreted as a judicial finding that Form 6 itself was illegal. He maintained the court had not reached a final conclusion on who made the disputed changes or whether they were unlawful.

Dispute Over Unilateral Action and Collective Decision

Patra referred to an Election Commission press release from September 26 stating the declaration attached to Form 6 for the SIR exercise had been upheld by the Supreme Court. He cited the Supreme Court’s May 27, 2026, judgment to argue that it did not support Gandhi’s interpretation regarding Election Commission documentation for the SIR exercise. Patra disputed the allegation that the SIR decision was taken unilaterally, stating the Bihar SIR order issued on June 24, 2025, was approved unanimously by all three Election Commissioners. Patra claimed the Election Commission reiterated in a fact-check response that the decision was collective and pointed to public records showing all three commissioners participated.
